They have said about direct payments. From what I understand they pay my MIL then she pays me. Do any of you know about this?

If they put in place the day centre and restbite I should be able to cope. Think I need to man up and stand up for myself more.

A minefield … most mines remain unmapped … even more exposed under Universal Credit , and even now ,
many step on one which was previously unmapped !

MIL gets pensions. I don’t get anything since giving up work. My husband is working so relying on him.

I have the paperwork now for attendance allowance.

You … Carers Allowance ( CA ).

Mother-in-Law … Attendance Allowance ( AA ).

Once AA is approved , that triggers you to claim CA … not before.

I’ve learned a bit about direct payments from reading the Ombudsmens reports when things have gone wrong. There have been cases of family member being paid from Direct Payments, but whether the HMRC is happy with that I’m not sure as they would expect tax and NI to be deducted.

As with anything said by SS, make sure you get it in writing!! Just go back to whoever said MIL can get Direct payments then pay you and ask them to confirm it, in writing.

Some Councils interpret the rules differently to another, and even in one area one person can have their own understanding, so check, check, double check and get it in writing.

Councils and their employees are very fallible

Recent real life case posted on thread 1 … DWP spotted the same as I did … not a carer , an employee … and
Employment Law kicks in.

Upstairs with CUK … I took DPs / AA / DLA or PIP as afar as I could … they know my conclusions … nothing heard back
for a couple of months … needs sorting so that ALL of us …ALL 7.8 million … know what the true state of affairs are …
and can act accordingly without fear of a possible challenge , either by the DWP or TaxMan , or both !

Especially vulnerable are those receiving payments and , at the same time , claiming INCOME related benefits !!!

Deal with this step by step.
To start with, have SSD/NHS identified ALL her needs and allowed enough time for them ALL?
Or are they expecting you to still do things for her for free.

My son had direct payments, which worked for a few years. It CAN give greater flexibility, but I’d suggest that you used them to pay someone you can trust and then you would have time for a good life of your own.

I can’t thank you all enough! Just talking and finding out things really helps. We do have power of attorney for finance but still waiting for the health and social care.
Just waiting now for Ss to do capacity and dols assessments. I am filling in the attendance allowance form then will apply for Carers allowance later.
I know have to do this but feel I can cope with help. Just need a break as I don’t think I have ever been so tired lol.

If you ring up for the AA or CA forms, then when they are sent to you, there will be a “date to return by”, it used to be 4 weeks. As long as you get it back within that time, the benefit will be backdated to the day you rang for the forms.
